Description: Better outcomes in litigation, like most things, are the result of preparedness and knowing what is going on. Early case assessment and case management are critical aspects of achieving better results for clients. This session is designed to give an overview of the steps for effective case management, and how to avoid the common pitfalls that plague case management.

Some of the topics will include:

•The nuts and bolts of Rule 26(f) meet and confer, and how the same strategy can be used in state court actions
•Effective case management orders and discovery protocols, and how to get the terms that will help the case progress
•Getting the court to engage (hint: if the lawyers don’t engage in early case assessment, don’t be surprised when the court doesn’t either)
•Dealing with lawyers who don’t want to participate in framing discovery (without just telling them the Rules require it)
•The 800 lb. gorilla – electronic discovery, early case assessment, and using case management as a tool to help your client control costs
