The Second Wave of Litigation Funding – Practical Issues and Ethical Considerations

Description:

In the not too distant past, litigation funding was topic of interest mostly to plaintiff's lawyers, limited to personal injury claims and employment litigation. Industry developments and economic shifts have resulted in a "second wave" of alternative funding for litigation, with companies marketing themselves as providing, and lawyers seeking to obtain, funding for sophisticated commercial and intellectual property litigation. This session will review practical aspects of the marketplace for litigation funding in ways mattering to lawyers and their clients and will explore ethical risks arising from and related to some of the most prevalent approaches to litigation funding taking shape in this second wave.
