Defending Sinkhole Insurance Claims in Tennessee

Tennessee is one of the leading states for sinkhole activity. Because of Tennessee's proneness for sinkholes and because of the significant damage that can result from them, the Tennessee General Assembly enacted Tenn. Code Ann. § 56-7-130 to impose certain obligations on homeowners insurance companies, including the requirement to make sinkhole insurance available. Since its enactment, sinkhole claims have been increasingly litigated and several questions have arisen regarding the meaning and significance of Tenn. Code Ann. § 56-7-130. This CLE will address the meaning and impact of that statute, including the recent attempts to amend it, and will provide lawyers a general framework to use when defending against sinkhole claims.
