Taking and Defending Effective Depositions

Description: You can't win a trial at deposition, but you certainly can lose one. This CLE is designed to avoid that outcome by addressing basic and intermediate deposition techniques in general personal injury cases. Attendees will hear from experienced litigators – both from the plaintiff and defense perspective – who will discuss key components of the deposition process. Specifically, attendees will learn how to:

• Prepare themselves and their clients for a deposition
• Identify potential sources of information – including social media sources – to be used during a deposition
• Use exhibits and documents effectively during a deposition
• Elicit exhaustive, expansive answers from witnesses
• Conduct “theory testing”
• Close off avenues of escape when questioning opposing witnesses
• Prepare for, take and defend an expert witness deposition
• Prepare for, take and defend a corporate representative deposition
• Know when and how to object when defending a deposition
• Gain admissions and information to be used later at trial or during negotiations

Finally, a portion of the program will be devoted to ethical considerations in deposition settings, dealing with obstreperous counsel and witness preparation.
