Description: A lawyer who has not handled an appeal before, or who has not handled one in several years, must first review all of the Rules of Appellate Procedure before filing an appeal. In addition, review of those rules in the Tennessee Rules of Civil Procedure applicable to appeals must be considered, as they can affect substantive rights, such as T.R.C.P. 59 concerning motions for new trial and motions to alter or amend. It is also helpful to know how to preserve issues for review on appeal in the trial court, and persons taking this course are referred to a companion online course that addresses those issues.

This course uses a question and answer format, supplemented by scenarios, that illustrate some of the problems that arise during many appeals. Careful attention to the rules will avoid these potential traps, and allow your appeal to be decided upon the merits. The course starts with the notice of appeal, distinguishes appeals as of right from discretionary appeals, and touches upon how the appellate record is compiled. It also covers oral argument, cost and stay bonds, and finally frivolous appeals.
