Brian Faughnan is a partner in the Memphis office of Adams and Reese, LLP, and serves as Chair of the firm’s Pro Bono committee. Mr. Faughnan represents, advises and counsels both corporate and private practicing lawyers and law firms on a wide variety of issues surrounding legal ethics and professional responsibility. He is a frequent author and speaker on these issues and serves chair of the Tennessee Bar Association’s Standing Committee on Ethics and Professional Responsibility. Mr. Faughnan is also a member of the Board of Governors for the Tennessee Bar Association and the chair of the ABA’s Firm Counsel Project – an initiative dedicated to building a community among lawyers throughout the nation who perform internal functions for their law firms related to ethics, risk management, or loss prevention. He co-authored, "In-House Counsel In The Liability Crosshairs, From Trusted Counselor to Vigilant Gatekeeper: The Evolving Liability Environment for Corporate Counsel" for the Association of Corporate Counsel in September 2007.
Mr. Faughnan also practices in the areas of complex commercial litigation, appellate litigation, and media law. He represents clients in a wide variety of matters both at the trial level and on appeal. He has significant experience in class action litigation, having not only successfully represented defendants in such proceedings, but also having represented plaintiffs’ classes in two lawsuits that ended in the certification of nationwide settlement classes involving multi-million dollar recoveries by the class. Mr. Faughnan has been counsel of record in three prominent published decisions of the Tennessee Supreme Court including: Memphis Publ’g Co. v. Cherokee Children & Family Servs., 87 S.W.3d 67 (Tenn. 2002); Clinard v. Blackwood, 46 S.W.3d 177 (Tenn. 2001) and Cross v. City of Memphis, 20 S.W.3d 642 (Tenn. 2000).
Mr. Faughnan received his Bachelor of Arts degree in International Studies from Rhodes College in 1995. He graduated magna cum laude from the University of Memphis Law School in 1998, where he served as the Comments Editor for the University of Memphis Law Review. Upon receiving his law degree, he served as a judicial law clerk to Magistrate Judge Diane K. Vescovo of the United States District Court for the Western District of Tennessee. He is admitted to practice law in all state courts of Tennessee, the Sixth Circuit, the United States District Courts for the Western and Middle Districts of Tennessee, the Fifth Circuit Court of Appeals, and the Supreme Court of the United States. He is a member of the Memphis, Tennessee and American Bar Associations. He is also a member of the Association of Professional Responsibility Lawyers, Media Law Resource Center, Ethics Committee, Leadership Memphis FastTrack Program and Litigation Counsel of America.
In recognition of his many contributions to the community and profession, Mr. Faughnan was selected as one of Memphis Business Journal's "Top 40 Under 40" for 2008, and was selected to participate in the FastTrack Program of Leadership Memphis. Mr. Faughnan is a member of the Litigation Counsel of America, an invitation-only trial lawyer honorary society. Mr. Faughnan is AV® Peer Review Rated by Martindale-Hubbell.
